Brook Edge Terms & Conditions
of Letting
Please read carefully before completing your booking form.
Signing and dating of the booking form confirms your acceptance of
all of the terms and conditions that have been put before you.
DEPOSIT
We will
hold a telephone booking for one week, until a booking deposit is received. A deposit of 25% of the full rental charge is
required to confirm the booking. Reservations are not confirmed until receipt of the deposit and funds have
been cleared.
BALANCE
OF RENTAL FEE
The
balance becomes due 4 weeks before your arrival date at Brook Edge. If the balance has not been paid by this
time, and communication has not been received then we reserve the right to re-let the cottage. Deposits will be
forfeited by the hirer of Brook Edge if communication or prior written agreement of late payment has not been received.
CANCELLATION
If you
need to cancel your holiday please advise us asap in writing. We will endeavour to re-let the property. If Brook
Edge is re-let then all monies paid will be refunded less £50 to cover re-letting costs and administration. If the cottage
is not re-let, however, then we will require the balance of the total rental fee. We will always endeavour, although
not guarantee, to re-let the property.
ARRIVAL
& DEPARTURE
Brook
Edge will be available to you from 3pm on the first day of your holiday and we require that you vacate the cottage by 10.00am
on your departure day. Lettings usually run from Friday to Friday. Any variations to this will have to have been made
in writing and agreed before your rental commences.
DAMAGE
DEPOSIT
The
damage deposit is payable at the time of the final balance payment. It is fully refundable one week after your holiday
has ended if no damage to the property or the contents has been sustained, the property is left tidy and the cleaning
managers have access to the property from 10.00am on the day of departure to carry out their duties.
GUEST
RESPONSIBILITIES DURING YOUR STAY
It is
your responsibility to put out the rubbish daily. It is also your responsibility if you have used the fire, to leave
them in a clean state and ready for use by the next guest. Any wood, coal or firelighters used should be replaced. If
for any reason these responsibilities are not carried out during your stay then unfortunately a £20 surcharge will be deducted
from your damage deposit.
LINEN
& CLEANING
Included
in the rental fee is bed linen, bath towels, hand towels and tea towels. On arrival all beds will be made up and towels
made available for your use. At the end of your stay, please leave all linen and towels in the cottage.
PETS
An additional
charge of £20 per pet is payable on booking. All pets must be kept downstairs
and are allowed only on the floor, not on the sofa or chair. Please remember
to always clear up after your pet as this keeps Port Isaac a beautiful and clean village.
If the cottage is left in an unclean or untidy state then a cleaning charge will be deducted from your damage deposit.
TENANTS OBLIGATIONS
- To be liable for any
and all damage to the property and its contents caused during the tenancy by the tenant and/or by members of the tenant’s
party and to recompense the Owners without limitation for the full cost or repair or replacement as may be applicable.
- To take good care of
the property and its contents.
- In the interest of all
guests, please do not smoke inside the property.
- To permit the owners,
agents and house managers reasonable access to the property.
- To not exceed the number
of people shown on the property description, nor part possession with the property with any other party, other than the person
detailed on the booking form.
- Use of the home and its
contents provided to the tenant by the owner are provided at entirely the tenant’s own risk, and no responsibility can
be accepted for any injuries to persons or loss or damage to any persons or persons’ property who use the property.
- The website, correspondence
and any advertising material are offered in good faith, and neither they nor any oral representations made by the Owners or
their agents form part of any agreement. The owners make no representations as
to the state or condition of any property, nor to the position, type or state of furnishings described on or shown in any
literature.
- The person signing the booking
form must be over 18, be a member of the party intending to occupy, and certifies that he/she is authorised to agree the booking
conditions on behalf of all persons included on the booking form, including those substituted at a later date.
- If for any reasons beyond
the Owners control the property is not available on the date booked (i.e. fire damage), or the property is unsuitable for
holiday letting, all rent and charges paid in advance by the hirer will be refunded in full but the hirer, and it’s
party, shall have no further claim against the owner.
- In no event will the
Owner be liable to the tenant for indirect or consequential loss or damages.
- If there shall be any
breach of these conditions by the tenant, the Owners or their agents reserve the right to re-enter the property and terminate
the tenancy without prejudice to the other rights and remedies of the Owners.
- The contracts is deemed
to have been made at Butlers Cottage, Calwich, Nr. Ashbourne, Derbyshire under English Law.
- All or any complaints
must be notified to the Owners immediately so that an on the site investigation can be made and, if necessary, remedial action
taken. In the event that items of equipment become unserviceable the Owners sole obligation will be to use reasonable
endeavours to rectify or replace the defective item with a broadly equivalent item, within a reasonable time period of being
notified of the defective item by the tenant. In no circumstances will compensation be paid for complaints raised after
the tenancy, by which time the Owner or agents will have been denied the opportunity to investigate and endeavour to put right
